General Terms of Use

1ARTICLE 1. DEFINITION OF THE PARTIES' ROLES

The purpose of this mandate is to define the financial services that will be provided by STUDELY to collect funds from the sender and then to transfer (deposit) these funds to the recipient's payment account in France.

The sender is any parent or relative of a student, based in Africa, who wishes to send money to France.

The recipient is a student who can prove their student status in France and their presence on French territory at the time of the service.

ARTICLE 2. DEFINITION OF STUDELY'S MISSIONS

STUDELY undertakes to perform the following services for the sender:
-Collection of funds paid by the sender (the Depositor);
-Transfer of funds to the recipient's payment account in France

ARTICLE 3. PAYMENT OF FUNDS

The sender (the Depositor) agrees to pay the amount indicated on the simulator [available here](https://espace.studely.com/#/tools/bank-price?langKey=fr) to the bank account whose details will be sent by email, after validation of this form.

The sender expressly acknowledges and accepts that the amount of funds or top-up deposited by them or their relatives will be transferred in Euros to the recipient's payment account in France at the daily exchange rate after all banking and/or exchange fees have been applied.

It is expressly agreed that the sender will bear all banking fees, exchange fees, and fees related to fund transfers from one country to another potentially charged by any credit institution.

ARTICLE 4. FUNDING THE PAYMENT ACCOUNT

It is expressly agreed that after depositing funds into STUDELY's bank account in Africa, the sender must send their deposit receipt by any electronic means to their recipient in France. The supporting document format can be a photo of the receipt (JPEG or PNG) or a scan of the document (PDF).

The   transfer recipient must then upload the   supporting document to the STUDELY application installed on their phone, by   initiating a funding operation (Receive Money Menu) for the amount they are entitled to receive.

The recipient's payment account will be credited within a maximum of 2 business days, from the date the supporting document is uploaded to the STUDELY application; subject to confirmation of receipt of funds in STUDELY's bank account.

Confirmation of the funding operation is evidenced by the update of the recipient's payment account balance.

ARTICLE 5. TRANSFER TRANSACTION AMOUNT

It is expressly agreed that the amount transferable to a recipient is capped based on the reason: -A maximum of €1500 per recipient per month for living expenses or personal needs. In these cases, no administrative supporting document is required; -A maximum of €10,000 per recipient per month for payment of tuition fees/down payment, accommodation, flight tickets, CVEC in France. In these cases, an administrative supporting document will be required from the recipient when funding their payment account.

If the maximum transfer amount authorized for the recipient is exceeded, the transaction will be rejected, and the amount to be sent will be refunded to the sender. Partial funding is not possible.

The sender will be informed of the rejection of their transaction by an email sent to the address provided when completing the transfer request form.

ARTICLE 6. SENDER REFUND

It is expressly agreed that the refund will be for the full total deposit amount, including the transfer fees initially due. The refund will be made through the same local channel used for receiving funds, in the currency used at the time of deposit: -If the funds were deposited by bank transfer, the refund will be made to the originating account of the transfer. -If the funds were deposited in cash, a cash availability notice (MAD) will be issued to the person who deposited the funds at the bank.

ARTICLE 7. MODIFICATION OF TRANSFER DATA

It is expressly agreed that changing the recipient (other than the one initially specified in the money transfer request form) is not possible after the funds have been deposited with the bank. However, the deposit amount can be modified when making a payment/transfer to STUDELY's local bank account.

ARTICLE 8. FIGHT AGAINST MONEY LAUNDERING AND TERRORIST FINANCING

The sender undertakes to comply with all international laws and conventions governing the fight against money laundering and terrorist financing, applicable in the countries where STUDELY's partner banks are located.
